It is almost always best for parents to jointly decide on custody and visitation (called “parenting time” by the courts) issues. The court uses “best interests of the child” standard and when the court gets involved they really don’t care what the parents “want” they care about what they believe meets this standard.
When determining custody both parties are presumed to be equal parents with no one person automatically deemed to have the first right of custody.
There are three basic forms of custody: Sole, Joint Legal with sole physical custody, Joint Custody.
Visitation is encouraged by the court to be as liberal as possible.
Both parents must complete a court mandated “Parenting Education Course.”
NOTE: Child support has NO bearing on visitation.
